SIUC Strengthens Employee Rights Through Freedom of Association and Trade Union Recognition Policy

Kuala Lumpur, Malaysia – 2025 – Spectrum International University College (SIUC) reinforces its institutional commitment to fair employment practices, employee rights and workplace inclusivity through the implementation of its Freedom of Association and Trade Union Recognition Policy, effective January 2025. The policy recognises the rights of academic and non-academic employees to freedom of association, lawful trade union membership and collective representation, supporting the institution’s commitment to Sustainable Development Goal 8 (Decent Work and Economic Growth).

SIUC recognises that freedom of association and trade union participation are essential components of responsible employment practices. Through its institutional policy, the university college acknowledges the rights of all eligible employees to establish, join and participate in legally registered trade unions in accordance with applicable Malaysian legislation. This commitment reflects SIUC’s recognition of the importance of employee representation in promoting fair employment conditions, workplace equality and constructive relationships between employees and university management.

The policy explicitly extends these rights to women and international employees, ensuring that freedom of association and lawful trade union participation are recognised without discrimination based on gender, nationality or employment position. SIUC maintains that all eligible academic and non-academic employees should have equal opportunities to exercise their lawful employment rights, participate in legitimate union activities and seek collective representation. This inclusive approach reinforces the institution’s commitment to equal treatment and fair employment practices across its workforce.

As part of its commitment to protecting employee rights, SIUC prohibits discrimination, intimidation and retaliation against employees who exercise their lawful rights to freedom of association and trade union participation. Employees are entitled to engage in legitimate union activities and seek representation without experiencing unfair treatment related to their lawful union membership. The institution’s Human Resources Department serves as the designated channel for employees to report concerns relating to discrimination or retaliation, supporting a workplace environment where employee rights are respected and protected.

SIUC’s policy is guided by Malaysia’s established legal framework, including the Federal Constitution of Malaysia (Article 10), Trade Unions Act 1959 (Act 262) and Industrial Relations Act 1967 (Act 177). These legal provisions provide the foundation for freedom of association, trade union registration and participation, collective representation and industrial relations in Malaysia. By aligning its institutional policy with these legislative requirements, SIUC demonstrates its commitment to recognising employees’ lawful rights and maintaining responsible employment practices within the higher education sector.

The implementation and communication of the policy are overseen by SIUC’s Human Resources Department, which is responsible for supporting compliance with applicable employment legislation and promoting awareness of employee rights. The policy also establishes a framework for periodic review to ensure its continued relevance and effectiveness. Effective from January 2025, the policy remains valid for three years, with a formal review scheduled for 2028. Earlier reviews may be conducted in response to legislative amendments or institutional developments.

SIUC recognises that protecting freedom of association and trade union rights contributes to a fair, inclusive and supportive working environment. By recognising the rights of women, international staff and other eligible employees to participate in lawful trade union activities, the institution supports workplace equality, employee representation and the protection of labour rights. These commitments are consistent with SDG 8, which promotes the protection of labour rights and safe, secure working environments for all workers, including migrant workers.

Through its Freedom of Association and Trade Union Recognition Policy, SIUC demonstrates its institutional commitment to protecting employee rights, promoting non-discrimination and supporting constructive employee representation. The institution remains committed to strengthening fair employment practices and maintaining a working environment where employees’ lawful rights are recognised and respected, contributing to decent work, workplace inclusivity and sustainable institutional development.
